Belarus suspends implementation of number of international treaties on avoidance of double taxation
Belarus has suspended the implementation of a number of international treaties on avoidance of double taxation from June 1, 2024 to December 31, 2026 in terms of articles that regulate the taxation of dividends, interest and income from the alienation of property. This is stipulated by the Council of Ministers Resolution No. 164 of March 7, 2024, reports BelTA with reference to the Ministry of Taxes and Levies.
The list of states with which the performance of certain provisions of international treaties is suspended includes the United States, France, Denmark, Poland, Sweden, Belgium, Lithuania, Latvia, the Netherlands, the Czech Republic, Germany, the United Kingdom and others. In total, there are 27 countries on the list.
Such a decision was taken in response to Western sanctions. The period of application of the retaliatory measure may be reduced in case of elimination of the circumstances that served as the basis for its application, or at the suggestion of the Ministry of Taxes and Levies.
The website of the Ministry of Taxes and Levies provides information on the procedure for applying the provisions of Resolution No. 164 with regard to the taxation of dividends received by foreign organizations from sources in Belarus, filling in the tax return (calculation) for tax on income in the form of dividends, income from debt obligations, from the alienation of property, including income from the alienation of shares (stakes) in the authorized capital (stocks) of Belarusian organizations, as well as the offsetting of tax paid (withheld) abroad in Belarus.
